Clear terms for using SwimZelo.

1. About these terms

SwimZelo is provided by BPS Designs Limited (“BPS Designs”, “we”, “us” or “our”), a company registered in England and Wales under company number 05360014. Our contact address is 2A Swordfish Business Park, Higgins Lane, Burscough, L40 8JW.

By accessing SwimZelo, you agree to these terms. If you do not agree, do not use the service. Our privacy notice explains how personal information is handled.

2. Your account and access

SwimZelo uses your SwimClub Manager account. You must be authorised to use that account, keep its credentials secure and tell your club or our support team promptly if you believe it has been compromised.

Your use of the connected SwimClub Manager service is also subject to the SwimClub Manager terms and conditions.

3. Permission to use SwimZelo

We give you a personal, limited, non-exclusive, non-transferable and revocable right to use SwimZelo for lawful, non-commercial purposes in accordance with these terms.

You must not misuse the service, attempt to access another person’s account or restricted systems, interfere with security or operation, introduce malicious code, scrape data at scale, reverse engineer the service except where the law expressly permits it, or use SwimZelo in a way that infringes another person’s rights.

4. Swimming information

SwimZelo presents information supplied through SwimClub Manager and your club. Although we aim to display it accurately, delays, corrections and differences from official records can occur. Your club, meet organiser or governing body remains the source to consult for an official result.

Targets, trends and other insights are informational only. They are not medical, health or professional coaching advice. Use your own judgement and seek qualified advice where appropriate.

5. Local data and sharing

Some preferences, targets and cached swimming information may be stored on your device so that the service works smoothly and can show previously loaded information offline. You can clear locally stored swimmer data by signing out.

If you choose to share a personal best or other content, you are responsible for choosing an appropriate recipient and for respecting the privacy of anyone identified in it.

6. Availability and changes

We work to keep SwimZelo available and reliable, but uninterrupted or error-free operation is not guaranteed. We may maintain, update, suspend or change parts of the service where reasonably necessary, including for security, legal, technical or operational reasons.

7. Intellectual property and third-party rights

SwimZelo, including its software, design, branding and original content, belongs to BPS Designs or its licensors. These terms do not transfer ownership to you.

Names, marks and information belonging to clubs, meet organisers, governing bodies or other third parties remain the property of their respective owners.

8. Mobile app marketplace terms

When a mobile app becomes available, the rules of the marketplace through which you download it will also apply. If you obtain the app from Apple’s App Store, Apple’s standard licensed application end user licence agreement applies unless we provide a different agreement with the app.

9. Our responsibility

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing affects your mandatory rights as a consumer.

To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when you agreed to these terms, business losses arising from personal use, or problems caused by third-party systems, your club’s source data, your device or your internet connection.

10. Ending access

You may stop using SwimZelo at any time. We may restrict or end access if you materially breach these terms, misuse the service, create a security risk, or if the connected account is closed or no longer authorised. Where appropriate, we will take reasonable steps to notify you.

11. Changes to these terms

We may update these terms to reflect changes to SwimZelo, the law or how we operate. We will publish the current version here and update the effective date. If a change materially affects your rights, we will provide additional notice where reasonably practicable.

12. Governing law and contact

These terms are governed by the laws of England and Wales. If you live elsewhere in the United Kingdom or another country, you retain any mandatory protections and rights to bring proceedings that apply under the law where you live.
